WHO WE ARE

TVI, Inc. d/b/a Savers is the controller and operator of multiple Services, including Savers®, Value Village®, 2nd Ave,® and other retail thrift store brands, as well as GreenDrop® and other donation sites and services accepting donations of gently used clothing, shoes, household goods and other items on behalf of our non-profit partners at our stores and surrounding communities. GENERAL DISCLOSURES

Each of the websites and mobile applications used to provide the Services are hosted in the United States. Your personal information collected by third party service providers and other vendors on our behalf is aggregated and transferred to the United States to improve our Services to you.

We collect a variety of different kinds of personal information from a variety of different individuals. What information we collect and the purposes for which it is collected will depend on the context of how you use our sites or Services. Depending on the region in which you reside, and to the extent permitted by law, we may process your personal information into aggregated, anonymized or de-identified form for the purpose of measuring, tracking and analyzing trends in sales and/or donation activity, including the location of the store or donation site visited. WHEN AND WITH WHOM DO WE SHARE YOUR INFORMATION

  1. Sale Of Personal Information And Targeted Advertising
    For U.S. residents, our disclosure of your personal information to our online advertising and analytics providers may constitute a sale of data or use of data for targeted advertising under certain state laws. Depending on your state of residence, you can opt-out of this sale of personal information and use of your data through the opt-out mechanism found in our Data Subject Request site. You should also opt-out of cookies using the methods outlined in our Cookies Policy. However, you may still see advertisements for Savers even if you opt-out because Savers advertises through a variety of methods that are not based on your personal information.   2. When And How We May Disclose Your Information With Others
    In the course of our business, we may disclose your Personal Information to other businesses and entities. We will only disclose your information with the following service providers or other external entities under the circumstances described below and solely to the extent that it is necessary to accomplish the goal and purpose of the disclosure. Therefore, we may disclose your personal information: 
    • To our database hosting vendors. Like many organizations, we utilize cloud databases to host our data, including your personal information, so that we can effectively and safely operate the sites and perform our Services. 
    • To our auditors. We may be subject to audits from a number of entities as well as due to our own internal auditing policies. MARKETING AND ADVERTISING

Email, Online Advertising, and SMS Marketing

You may opt-out of receiving marketing and promotional messages from Savers, if those messages are powered by Savers, by following the instructions in those messages. If you decide to opt-out, you will still receive non-promotional communications relevant to your use of our Services.

Cookies

Like many online platforms, Savers and its analytics vendors use server logs and automated data collection tools, such as browser cookies, pixel tags, scripts, and web beacons. These tools are used for analytics purposes to enable Savers to understand how users interact with the sites and Services. Do Not Track (“DNT”): DNT is an optional browser setting that allows you to express your preferences regarding tracking across websites. ANALYTICS

We may work with service providers to provide site metrics and other analytics services. These service providers may use cookies, web beacons, and other technologies to collect information, such as your IP address, identifiers associated with your device, other applications on your device, the browsers you use to access our sites and Services, webpages viewed, time spent on webpages, links clicked and conversion information (e.g., transactions entered into). Savers is not responsible for the privacy practices or the content of such websites, including any websites that may indicate a special relationship or partnership with us (such as co-branded pages or "powered by" or "in cooperation with" relationships). We do not share information we gather with other websites or any other entities or individuals unless such sharing is disclosed to you in advance through this Privacy Policy. Other linked websites, however, may collect personal information from you that is not subject to our control. To ensure protection of your privacy, always review the privacy policy of the websites you may visit by linking from the sites. Please note that this Privacy Policy applies only to our sites, and not to other companies' or organizations' websites to which we link.



SOCIAL MEDIA

We may collect information from other sources, such as social media platforms that may share information about how you interact with our social media content. We do not control how your personal information is collected, stored, or used by such third-party websites or to whom it is disclosed. You should review the privacy policies and settings on any social media website that you subscribe to so that you understand the information they collect and may be sharing. If you do not want your social media websites to share information about you, you must contact that website and determine whether it gives you the opportunity to opt-out of sharing such information. Savers is not responsible for how these third-party websites may use information collected from or about you.

Further, our sites may include social media features, such as the Facebook Like button. Our integration of these features may allow third-party social media to collect certain information, such as your IP address and which page(s) you are visiting when using our sites and Services, and to set a cookie to enable that feature to function properly. Your interactions with these features are governed by the privacy policy of the company providing it.



HOW LONG WE RETAIN YOUR INFORMATION

We generally retain your information as long as reasonably necessary to provide you the Services or to comply with applicable law and in accordance with our record management policy. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information, and whether we can achieve those purposes through other means and the applicable legal requirements. We may retain copies of information about you and any transactions or Services you have used for a period of time that is consistent with applicable law, applicable statute of limitations, or as we believe is reasonably necessary to comply with applicable law, regulation, legal process or governmental request, to detect or prevent fraud, to collect fees owed, to resolve disputes, to address problems with our Services, to assist with investigations, to enforce other applicable agreements or policies or to take any other actions consistent with applicable law.



CHILDREN’S DATA

We do not knowingly collect the personal information of minors under the age of 16. Our websites and services are intended for individuals over the age of 16. If you are under the age of 16 and have already provided personal information through the sites, please have your parent or guardian contact us immediately using the information provided under Contact Us so that we can remove such information from our files.



RETENTION OF PERSONAL INFORMATION

We have established minimum and maximum retention periods and procedures for maintaining and destroying your personal information based on the type of data, the system, and our legal and business needs. When you make a data subject request, including to delete your data, we retain specific records for up to seven years to show our compliance with your request.

Some of our retail locations include video monitoring that may be used to identify you or others. Video recordings are retained for up to 45 days unless there is a complaint, investigation, lawsuit or other legitimate basis, in which case, a file may be created in our records management system related for legal inquiries.

When personal information is retained to make a decision about you, we will retain such information for the period required in order to comply with our internal record management policies.



SECURITY

We take reasonable measures, including administrative, technical, and physical safeguards, to protect your information from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. Nevertheless, no online or computer environment is 100% secure, and we cannot guarantee absolute security of the transmission or storage of your information. We hold information about you both at our own premises and with the assistance of service providers. Further public disclosure here of our security measures could aid those who might attempt to circumvent those security measures. To ensure that our employees comply with our privacy policies, we have developed a training program that provides all employees who work with consumer data with the tools and knowledge to protect your personal information in all aspects of their work. 1. What Data Rights Do You Have?

Right to Confirmation and Access: You have the right to confirm whether or not Savers is processing your personal information and to access such personal information. Right to Correct: You have the right to request that Savers correct inaccurate personal information that we maintain about you, taking into account the nature of the personal information and the purposes of the processing of the personal information.

Right to Delete: You have the right to request that Savers delete the personal information that Savers maintains about you. Please note this right is not unlimited as Savers may be permitted by law to limit or refuse this request.

Right to Portability: You have the right to request to receive a copy of your personal information in a portable and readily usable format, to the extent technically feasible.

Right to Opt-Out of Targeted Advertising: You have the right to request to opt out of Savers’ processing of your personal information for purposes of targeted advertising. “Targeted advertising” generally means displaying advertisements where the advertisement is selected based on personal information obtained from your activities over time and across non-Savers websites or online applications to predict your preferences or interests.

Right to Opt-Out of Sale or Sharing: You have the right to request to opt out of Savers’ sale or sharing of your personal information in certain contexts. While Savers does not sell your personal information for money, some transfers of data to certain vendors and other third parties may constitute a sale under some state laws. Right to Opt-Out of Profiling: Savers does not engage in automated profiling. Therefore, we do not offer a way to opt-out of profiling, and neither do we look for or process any online browser preference or opt-out signals that purport to opt-out of profiling.

Right to Non-Discrimination: You have the right to not be discriminated against for exercising any of your rights. However, note that the exercise of certain privacy rights may make it so that we are no longer able to provide you with certain services or communications. For example, if we delete all of your personal information, we cannot send you e-mails or other communications.

Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to limit the use or sharing of your sensitive personal information (for example race, religious preferences, health or criminal history). However, we do not collect or disclose your sensitive personal information.

3. How We Process Data Rights Requests

Once we receive your request to exercise a right, we will confirm receipt and begin to evaluate, and if appropriate, process the request.

Notice of Financial Incentives

California residents are entitled to certain information about Savers’ financial incentive programs.

Savers may collect personal information about you when you voluntarily join the Super Savers Club® customer loyalty program. By joining Super Savers Club, you receive:

  • One point for every eligible dollar spent in our stores
  • One Hundred points equals one reward. Each Reward is good for 20% off a future purchase of up to $100 and is valid for 90 days
  • Exclusive email offers like special promotions, events and exclusive coupon offers
  • Birthday coupons

Under the CCPA, Super Savers Club is considered a Financial Incentive Program. To provide you with the incentives described above, we use personal information about you including your name, phone number, email address, purchase history, birthdate, etc. to identify you as a member of the program and provide you with relevant messaging, experiences, and deals. The types of information we collect include:

  • first name, last name, date of birth
  • personal mailing address, email address, telephone number
  • details about the products and services you have purchased from us and the corresponding transactions, including the store in which the purchase occurred
  • your password and communication preferences

We incur a variety of expenses related to the Super Savers Club program. We make this investment so that we can offer the kinds of benefits our members enjoy. Expenses associated with the program include the discounts earned on purchases when using your Super Savers Club account, exclusive coupons, and special sales for members only, and the birthday discount, offered to members who provide the day and month of their birthday in their Super Savers Club account. The expenses associated with the Super Savers Club program incentives will vary as it is dependent on each member’s engagement with the loyalty program, including the amount that you spend using your Super Savers Club account and the frequency that you use the discounts and coupons we offer. On average, active U.S. members of the Super Savers Club program save up to $33.27 more per year than nonmembers.

The estimated average value that Savers receives from each Super Savers Club program member’s data is $2.80 per sales transaction, representing the difference between the product margins for purchases by members versus those by nonmembers minus the expenses related to the collection and retention of this data. The sale and discount incentives in the Super Savers Club program are reasonably related to the value of the data you provide because that data helps drive additional customer sales and revenue, which informs us on the types of incentives to offer members in the program.
